Age Discrimination
Age discrimination is a type of discrimination that occurs when a person is subjected to bias and/or mistreatment due to his/her age. In cases involving age discrimination, it is assumed that a person is being mistreated due to his/her age, and that he/she would be treated more appropriately if he/she were either older or younger, depending on the situation. Age discrimination is an intolerable form of bias and prejudice and it is illegal.
Throughout the years, numerous people have reported that they have been victims of age discrimination in the workplace. This can happen to people who are believed to be too young, but more commonly happens to individuals who are over the age of 40. Often times, employers assume that because a person is getting older, he/she will not work as hard as a person who is younger. Employers may also discriminate based upon a person’s age if they feel that the person has a high salary, and can be replaced by someone who is younger and making a smaller salary.
Age Discrimination in Employment Act of 1967 (ADEA)
In 1967, the Age Discrimination in Employment (ADEA) was passed to protect individuals who are over forty from age discrimination in the work force. The ADEA protects both current employees and prospective employees who have become victims of age discrimination. According to the ADEA, it is illegal for employers to discriminate against an employee based upon his/her age in relation to the terms of his/her employment. This means that employers cannot: hire, fire, lay off, take away benefits, deny promotion, or deny salary increases due to an employee’s age.
