Failure to Grant
Failure to Grant is a term that is used when an employer fails to grant an employee time off from work or fails to pay an employee for time off from work. Failure to grant applies to situations where an employee must take time off of work for jury duty, to vote, for military leave, or for required medical exams.
According to the law, employees have the right to take time off of work if they are asked to serve on a jury, if they wish to vote, and if they need to seek medical treatment. If an employer denies an employee’s request to take time off of work for any of the aforementioned reasons, the employer is behaving unlawfully by failing to grant the employee time off.
Once an employee has been denied time off from work by his/her employer, and he/she needed the time off for jury duty, military leave, medical exams, or to vote, he/she should speak with his/her company’s upper management or Human Resources Department.
