Racial Discrimination

Racial discrimination is a type of discrimination that occurs when a person is subjected to bias and/or mistreatment due to his/her race and/or ethnicity.  In cases involving racial discrimination, it is assumed that a person is being treated unfairly due to his/her race, and that if the person were of a different race, he/she would be treated better. 

According to the law, an employee cannot be fired or denied employment due to his/her race.  Additionally, an employee’s terms of employment should not be impacted by his/her race.  This means that it is wrong and illegal for an employee to lose benefits, be denied a promotion, be laid-off, or be denied a higher salary based upon his/her race.  Racial discrimination is an illegal form of prejudice that should never occur within a work environment, as it directly violates an employee’s Civil Rights, and can lead to legal action against the employer.

The Civil Rights Act of 1964 protects individuals against employment discrimination on the basis of race as well as sex, age, color, national origin, and religion. When a person is subjected to racial discrimination, his/her Civil Rights will have been violated.  According to the Civil Rights Act, people have the right to be treated fairly and without bias toward their ethnicity.  Every person’s Civil Rights are protected and regulated by the US federal government, which means that people can take legal action if they become victims of racial discrimination.
